General terms and conditions for consumers for the purchase of

and for the use of network vouchers

Regional Hero GmbH (hereinafter referred to as "Regional Hero") is a publisher of locally limited
network vouchers. These are vouchers that can be purchased digitally, as a PDF or as a pre-printed
voucher card by consumers (Section 13 BGB) and redeemed in participating acceptance points of the respective
network to pay for goods and services.

A. General information

1. These General Terms and Conditions of Regional Hero GmbH, legally represented by
   Managing Director Pascal Schreiber, Commercial Register: Berlin Charlottenburg - HRB 218080 B, Regional Hero GmbH Propststr. 8 10178 Berlin, e-mail: support@das-b-card.de, apply to the purchase and use of network vouchers for consumers (§ 13 BGB).
   2. The offer is only aimed at persons with unlimited legal capacity. Persons with limited legal capacity
   (e.g. young people under the age of 18) may only use the offer with the consent of their legal representative
   

B. Subject matter of the contract and voucher conditions

On the online platform provided by Regional Hero or at selected issuing points
, vouchers of a certain monetary value can be purchased for the purchase of goods or services from other companies belonging to the respective network,
. Customers can order the network vouchers offered via the online platform
and send them to themselves or to a third party to be specified by them
.

1. when purchasing a voucher at an issuing office, the consumer acquires the network voucher as a card in
cheque card format, which the issuing office brokers to end customers in the name and on behalf of the issuer against payment
. The issuing office acts as a secondary commercial agent within the meaning of Section 92b of the German Commercial Code (HGB)
vis-à-vis the issuer.

2. when purchasing vouchers on the online platform, the customer submits a binding offer online, which can be accepted by Regional Hero after
receipt of the invoice amount on one of Regional Hero's accounts
. The offer is accepted by Regional Hero by sending an order confirmation or by sending the
requested vouchers.
The network vouchers are sent either electronically (e.g. PDF by e-mail) or by post, depending on the shipping method available at the time of the order
. The customer determines the
electronic communication service to be used. Regional Hero is not responsible for the availability and functioning of the
customer's access options to the
communication services (e.g. e-mail program) required for the receipt of vouchers. The same applies to the
availability of a gifted third party.
If the consumer has violated these voucher conditions in the past or has otherwise violated contractual
obligations towards Regional Hero, we reserve the right to no longer execute future orders without prior notice
.

3. vouchers that are ordered on the online platform and sent by post must first be activated
. All other vouchers can be used immediately.

4. Regional Hero will deposit the
funds received from the consumer as part of the voucher purchase in one or more accounts at one or more German credit institution(s).

5. each voucher has a unique QR code, a unique voucher number and a PIN.
The QR code must be readable by a standard smartphone before it can be used. The
voucher must be presented at the point of acceptance. The network vouchers

1. are not issued to a specific person and are therefore transferable.

2. can also be partially redeemed and the amount can be distributed to different acceptance points
.

3. may not be reproduced or manipulated in any other way under any circumstances, otherwise
will lose its validity.

4. are valid for three years after the year of issue. After the expiry date, the voucher
can no longer be used. The validity refers to the individual top-up. The
voucher balance can therefore consist of partial amounts with different validity periods.

5. cannot be used to purchase other network vouchers or other e-money products
.

6. the contract term between the consumer and Regional Hero corresponds to the validity of the voucher
in accordance with B.5.d. of these voucher conditions.

7. costs for the consumer for the purchase of network vouchers are incurred when purchasing via the online platform.
The costs are shown separately as part of the invoice amount and are to be paid by the consumer
to Regional Hero when placing the order. The acceptance points do not charge any fees or surcharges when using the voucher as a
means of payment.

8. network vouchers can be used to make cashless payments at all participating points of acceptance, which are usually recognizable by a
marker in the entrance area and are always listed on the online platform,
. The corresponding amount is debited from the credit balance of the voucher card
to the nearest cent. If there is a (remaining) amount on the voucher that is not sufficient to settle the full
payment obligation to the acceptance point, the acceptance point is free to reject the payment with
the network voucher and to demand that the full amount be paid with a
uniform means of payment.

9. nevertheless, when using the network voucher as a means of payment, the acceptance point remains the sole
contractual partner of the consumer. Regional Hero assumes no liability or responsibility for the goods
and/or services of the points of acceptance. Regional Hero is therefore only liable to the consumer
for the possibility of redemption at the participating acceptance points, i.e. that they accept the voucher as a means of payment for the goods or services offered on presentation of a
valid voucher.
Regional Hero is furthermore not liable for the fact that a particular acceptance point is still a participant in the voucher network at the time of redemption
.
Regional Hero is liable without limitation in cases of intent and gross negligence and in cases of simple negligence only for
damages resulting from injury to life, body or health, as well as for damages resulting from the
breach of a material contractual obligation, i.e. an obligation that characterizes the contract and on whose
fulfillment by Regional Hero the consumer has relied. In the event of a breach of a material contractual obligation
, liability is limited to compensation for foreseeable, typically occurring damages and
liability for indirect damages, in particular loss of profit, is excluded. This does not apply if
Regional Hero has fraudulently concealed a defect or has exceptionally assumed a quality guarantee
, as well as in the case of claims under the Product Liability Act.

10. the credit balance on the network voucher can be checked on the online platform or by scanning the QR code with
using a commercially available QR code scanner. The PIN
must be entered in each case.

11. network vouchers are to be kept and treated anonymously and like cash. The risk of loss,
theft or damage is borne solely by the consumer. Regional Hero cannot provide any compensation
in such cases.

12. the network voucher is used as a means of payment and we are therefore interested in and
obliged to provide consumers with the following information on payment services: The issuer of the
Network Voucher is Regional Hero GmbH with its registered office in Berlin and the address Propststr. 8 , 10178
Berlin. We are a limited liability company (GmbH) under German law. The competent court at
is Berlin. We are registered in the commercial register under number HRB ..... We can be contacted at
by post or by e-mail at support@das-b-card.de

In accordance with Art. 248 § 4 EGBGB, the transmission of the
contractual conditions in text form can be requested at any time during the validity of the voucher. You will receive this information on request from us at
by post or email.
The offer of network vouchers from Regional Hero complies with the "limited network" exception
within the meaning of
Section 2 (1) No. 10 a) of the German Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz - ZAG). 

C. Statutory right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving reasons by means of a clear statement (e.g.
a letter sent by post, fax or e-mail). The revocation period is
fourteen days from the day of the conclusion of the contract and after receipt of this instruction. In order to exercise your right of revocation
and to comply with the revocation period, it is sufficient to send the revocation in good time if the
declaration is made on a durable medium (e.g. letter or e-mail). The revocation must be sent to:

You can use the sample revocation form from Regional Hero for the revocation, but this is not mandatory

Please be sure to include the order number of the order process as well as the voucher number
and the PIN in the revocation, as we cannot process your revocation without this information. Please do not forget to include your bank details (IBAN) in your revocation
.

Consequences of revocation

In the event of an effective revocation, the services received by both parties must be returned. If you have requested
that the services should already begin during the revocation period, you are obliged to pay
compensation for the value of the services provided up to the time of revocation and to pay us a reasonable
amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the
right of revocation with regard to this contract in comparison to the
total scope of the services provided for in the contract. If this obligation to pay
compensation exists, this may result in you having to fulfill the contractual payment obligations for
the period up to the revocation. Your right of withdrawal expires prematurely if the contract has been completely fulfilled by both
parties at your express request before you have exercised your right of withdrawal.
Obligations to reimburse payments must be fulfilled within 30 days. The period begins
for you with the dispatch of your declaration of revocation and for us with its receipt.
END OF THE RIGHT OF WITHDRAWAL
Expiry of the right of withdrawal
In the case of a contract for the provision of services, the right of withdrawal expires when we have provided the
service in full and have only begun to perform the service after you have given your express consent to
and at the same time confirmed your knowledge that your
right of withdrawal expires upon complete fulfillment of the contract by us.

D. Final provisions

1 German law shall apply. The UN Convention on Contracts for the International Sale of Goods and the conflict of laws are excluded; Art. 3 para. 3, para.
4 Rome I Regulation remain unaffected. In business transactions with consumers domiciled in the EU, the law of the consumer's domicile shall also apply by way of exception
if mandatory
consumer protection provisions are involved.
2. Communication with the consumer is generally by email.

Amendments to the contract with the consumer, including these voucher terms and conditions, must be made in text form (e.g. letter, email), as must any contract-related declarations by the consumer or by Regional Hero.
4. Should individual provisions of the contract with the consumer, including these
voucher terms and conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining
provisions. In this case, the statutory provisions shall apply
