General terms and conditions for consumers for purchase

and for the use of network vouchers

The Regional Hero GmbH (hereinafter referred to as "Regional Hero") is the publisher of locally limited
network vouchers. These are value vouchers that can be purchased digitally, as PDF or as pre-printed
voucher card by consumers (§ 13 BGB) and redeemed in participating acceptance points of the respective
network for the payment of goods and services.

A. General Information

1. Diese Allgemeinen Geschäftsbedingungen der Regional Hero GmbH, gesetzlich vertreten durch den
   Geschäftsführer Pascal Schreiber, Handeslregister: Berlin Charlottenburg – HRB 218080 B, Regional Hero GmbH Propststr. 8 10178 Berlin, E-Mail: support@das-b-card.de, gelten für den Erwerb und die Nutzung von Netzwerk-Gutscheinen gegenüber den Verbrauchern (§ 13 BGB).
   2. Das Angebot richtet sich nur an unbeschränkt geschäftsfähige Personen. In der Geschäftsfähigkeit
   beschränkte Personen (z.B. Jugendliche vor Vollendung des 18. Lebensjahres) können das Angebot nur mit
   Zustimmung des gesetzlichen Vertreters nutzen

B. Subject matter of the contract and voucher conditions

On the online platform provided by Regional Hero or at selected issuing points
, vouchers for a certain monetary value can be purchased to purchase goods or services from other companies belonging to the respective network
. Via the online platform the customer
can order the network vouchers offered and send them to himself or a third
person to be determined by him.

1. when purchasing a voucher at an issuing office, the consumer purchases the network voucher as a card in
cheque card format, which the issuing office arranges for end customers in the name and on account of the issuer against payment
. The issuing office acts as a commercial agent as a sideline in the sense of §92b HGB
towards the publisher.

2) When purchasing vouchers on the online platform, the customer makes a binding offer online, which can be accepted by Regional Hero after
receipt of the invoice amount on one of Regional Hero's accounts
. The offer is accepted by Regional Hero by sending an order confirmation or by sending the desired vouchers to
.
The network vouchers will be sent either electronically (e.g. PDF by e-mail) or by post, depending on the mode of dispatch
available at the time of ordering. The customer determines the electronic communication service
to be used. Regional Hero is not responsible for the availability and functioning of the
customer's required access to the
communication services (e.g. e-mail programme) required for the receipt of vouchers. The same applies to the
accessibility of a third party receiving a gift.
If the consumer has violated these voucher conditions in the past or has otherwise breached contractual
obligations towards Regional Hero, we reserve the right not to execute future orders without prior notice
.

3. vouchers that are ordered on the online platform and sent by post must first be activated
. All other vouchers are immediately ready for use.

4. Regional Hero will deposit the
money received from the consumer within the framework of the voucher purchase to one or more accounts at one or more German credit institutions.

5. each voucher has a unique QR code, a unique voucher number and a PIN
The readability of the QR code by a standard smartphone is a prerequisite for use. The
voucher must be presented at the acceptance point. The network vouchers

1. are not issued to a specific person and are therefore transferable

2. can also be partially redeemed and the amount can be distributed at various acceptance points
.

3. may under no circumstances be reproduced or manipulated in any other way and otherwise
will lose its validity.

4. are valid for three years from the year of issue. After the expiry date, the voucher
can no longer be used. The validity refers in each case to the individual recharge. The
voucher credit can therefore consist of partial amounts with different validity.

5. cannot be used to purchase other network vouchers or other e-money products

6. the duration of the contract between the consumer and Regional Hero corresponds to the validity of the voucher
according to B.5.d. of these voucher conditions.

7. costs for the consumer for the purchase of network vouchers are incurred when purchasing via the online platform.
. The costs are shown individually as part of the invoice amount and are to be paid by the consumer
to Regional Hero when ordering. The points of acceptance do not charge any fees or surcharges when the voucher is used as
means of payment.

can be used to make cashless payments with the network vouchers at all participating points of acceptance, which are generally identifiable by a
marker in the entrance area and are always listed on the online platform. The corresponding amount is debited to the cent from the credit balance of the voucher card
. If there is a (remaining) amount on the voucher which is not sufficient to settle the full
payment obligation to the acceptance point, the acceptance point is free to reject the payment with
the network voucher and to demand that the payment of the full amount be made with a
uniform means of payment.

9. if the network voucher is used as a means of payment, the acceptance point remains the sole
contractual partner of the consumer. Regional Hero accepts no liability or responsibility whatsoever for the goods
and/or services of the acceptance point. Therefore, Regional Hero is only liable to the consumer at
for the possibility of redeeming the voucher at the participating points of acceptance, i.e. that Regional Hero accepts the voucher as a means of payment for the goods or services offered on presentation of a valid
voucher.
Regional Hero is further not liable for the fact that a particular acceptance point is still
participant in the voucher network at the time of redemption.
Regional Hero has unlimited liability for intent and gross negligence and for simple negligence only for
damages resulting from injury to life, body or health, as well as for damages resulting from the
violation of a fundamental contractual obligation, i.e. such an obligation which characterises the contract and on whose
fulfilment Regional Hero the consumer has relied. In the event of a breach of an essential contractual obligation
, liability is limited to compensation for foreseeable, typically occurring damage and
liability for indirect damage, in particular loss of profit, is excluded. This does not apply if
Regional Hero has fraudulently concealed a defect or, in exceptional cases, has given a quality guarantee
, as well as in the case of claims under the Product Liability Act.

10. the credit balance on the network voucher can be queried on the online platform or by scanning the QR code with
a standard QR code scanner. For this purpose, the PIN
must be entered in each case.

11. network vouchers are anonymous and must be kept and treated like cash. The risk of loss,
theft or damage is borne solely by the consumer. Regional Hero cannot provide a replacement in these cases
.

12. Der Netzwerk-Gutschein wird als Zahlungsmittel eingesetzt und daher sind wir interessiert daran und
verpflichtet, den Verbrauchern folgende Informationen zu Zahlungsdienstleistungen zu geben: Herausgeber des
Netzwerk-Gutscheins ist die Regional Hero GmbH mit Sitz in Berlin und der Adresse Propststr. 8 , 10178
Berlin. Wir sind eine Gesellschaft mit beschränkter Haftung (GmbH) nach deutschem Recht. Der Sitz des
zuständigen Gerichts ist Berlin. Wir sind im Handelsregister unter Nummer HRB …. eingetragen. Wir sind
postalisch oder über E-Mail unter support@das-b-card.de
zu erreichen.
Gemäß Art. 248 § 4 EGBGB kann während der Gültigkeit des Gutscheins jederzeit die Übermittlung der
Vertragsbedingungen in Textform eingefordert werden. Diese Informationen erhalten Sie auf Anfrage von uns
postalisch oder per E-Mail.
Das Angebot der Netzwerk-Gutscheine von Regional Hero entspricht der Bereichsausnahme „begrenztes Netz“
im Sinne des
§ 2 Abs. 1 Nr. 10 a) Zahlungsdiensteaufsichtsgesetz (ZAG). 

C. Legal right of withdrawal

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen mittels einer eindeutigen Erklärung (z.B.
ein mit der Post versandter Brief, Telefax oder E-Mail) diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt
vierzehn Tage ab dem Tag des Vertragsschlusses und nach Erhalt dieser Belehrung. Um Ihr Widerrufsrecht
auszuüben und zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs, wenn die
Erklärung auf einem dauerhaften Datenträger (z. B. Brief, oder E-Mail) erfolgt. Der Widerruf ist zu richten an:

Sie können für den Widerruf das Muster-Widerrufsformular von Regional Hero verwenden, das jedoch nicht
vorgeschrieben ist.
Bitte geben Sie bei dem Widerruf unbedingt die Bestellnummer des Bestellvorgangs sowie die Gutscheinnummer
und den PIN an, da wir Ihren Widerruf ohne diese Angaben nicht bearbeiten können. Bitte vergessen Sie nicht,
bei Ihrem Widerruf auch Ihre Bankverbindung (IBAN) anzugeben.

Consequences of revocation

In the event of an effective revocation, the services received by both parties must be returned. If you have requested
to start the services already during the revocation period, you are obliged to pay
compensation for the value of the services provided until the revocation and you have to pay us an appropriate
amount, which corresponds to the proportion of the services already provided until the time you inform us about the exercise of the
right of revocation with regard to this contract, compared to the
total scope of the services provided in the contract. If this obligation to pay
compensation for lost value exists, this may mean that you will have to fulfil the contractual payment obligations for
for the period up to the cancellation. Your right of revocation expires prematurely if the contract is completely fulfilled by both
sides at your express request before you have exercised your right of revocation.
Obligations to refund payments must be fulfilled within 30 days. The period begins
for you with the dispatch of your revocation declaration and for us with its receipt.
END OF THE RIGHT OF REVOCATION
Expiry of the right of revocation
The right of revocation expires in the case of a contract for the provision of services when we have fully provided the
service and have only begun to provide the service after you have given your express consent to
and at the same time have confirmed your knowledge that your
right of revocation expires when the contract is fully performed by us.

D. Final provisions

1 German law applies. The UN Convention on Contracts for the International Sale of Goods and the conflict of laws are excluded; Art. 3 para. 3,
4 Rome I Regulation remains unaffected. In business transactions with consumers resident in the EU, the law of the consumer's place of residence shall also apply in exceptional cases to

consumer protection provisions.
2. The communication with the consumer is usually by e-mail.
3. Changes to the contract with the consumer including these terms and conditions for vouchers require
as well as any contract-related declarations by the consumer or Regional Hero in text form (e.g. letter, email).
4. Should individual provisions of the contract with the consumer, including these
voucher conditions be or become invalid in whole or in part, the validity of the remaining provisions of
shall not be affected. In this case the legal provisions apply
